Period of stay increase proposed for NAFTA TN visas

USCIS announced a proposal today to increase the period of stay for NAFTA TN professional worker visas from one year to three years.

Canadian and Mexican citizens may apply for a nonimmigrant NAFTA TN visa if they meet the educational and professional requirements for one of the approximately 60 professions listed in the North American Free Trade Agreement.

TN visa holders may apply for a visa extension each year with no limit on the number of extensions as long as they can show evidence of employment in the U.S. and meet the same requirements as when they entered. The reason for the extension proposal is to ease administrative burdens and costs on the applicants and their dependents, and benefit U.S. employers by keeping employees in the U.S. for a longer period of time.

Update: The proposal has been approved and the the period of stay has been increased from one to three years.
